How we work
Standard route
Applications are examined in filing order. Examination timing varies and may take around a year in practice.
Expedited route · Rule 34
After an official application number is received, expedited processing may be requested in Form TM-M with the prescribed fee. Examination is ordinarily completed within three months of the request.
↓
01 · Application
Trademark application is filed with the appropriate class, applicant details and supporting documents.
↓
02 · Registry review
The Trade Marks Registry examines the application. The examination may result in acceptance or an objection.
↓
Accepted
If accepted, the application moves forward for publication in the Trade Marks Journal.
Objected
A response is filed to the examination report. A show-cause hearing may be scheduled; the application may then be accepted or refused.
↓
04 · Public notice
Once accepted—directly or after response/hearing—the mark is published in the Trade Marks Journal.
↓
05 · Four-month window
Third parties may oppose the application within four months from journal publication.
↓
No opposition / opposition dismissed
The mark proceeds to registration and a registration certificate is issued, subject to completion of Registry requirements.
Opposition filed
The matter proceeds through pleadings, evidence and hearings. The mark may be accepted for registration or refused.
Indicative process only. Timelines and outcomes depend on Registry workload, objections, hearings, oppositions and the facts of each application. This information is not legal advice.
